These Terms of Service ("Terms") govern your use of the website located at torqueautorepair.com and the mobile automotive repair services provided by Torque Auto LLC ("Company," "we," "our," or "us"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

1. Services

Torque Auto LLC provides mobile automotive repair and maintenance services throughout San Diego County, California. Our services include, but are not limited to, diagnostics, brake service, oil changes, battery replacement, electrical repairs, and other automotive maintenance and repair work as agreed upon between the customer and Torque Auto LLC.

All services are subject to a written or digital work authorization signed by the customer prior to commencement of work, as required by the California Bureau of Automotive Repair (BAR).

2. Estimates and Pricing

All estimates provided are good-faith approximations based on the information available at the time of the estimate. Final pricing may vary if additional issues are discovered during the repair process. We will contact you for authorization before performing any work that exceeds the original estimate.

Prices listed on our website are approximate ranges and are not guaranteed quotes. Actual pricing depends on vehicle make, model, year, condition, parts availability, and labor required.

A diagnostic fee may apply for assessment services. This fee will be disclosed prior to performing any diagnostic work.

3. Work Authorization

Before any repair work begins, you will be required to sign a work authorization form, either in person or digitally through our website. By signing the work authorization, you:

• Authorize Torque Auto LLC to perform the described services on your vehicle
• Acknowledge the estimated cost of services
• Agree to pay for all authorized services upon completion
• Confirm that you are the vehicle owner or have authority to authorize repairs
• Acknowledge that Torque Auto LLC is not responsible for loss or damage to vehicles or articles left in vehicles in case of fire, theft, or any other cause beyond our control

4. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, major credit cards, and other payment methods as indicated at the time of service. Returned checks are subject to a returned check fee.

For services requiring parts to be ordered in advance, a deposit may be required. Deposits are non-refundable if you cancel after parts have been ordered.

Accounts not paid within 30 days of service completion may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by California law, whichever is less.

5. Warranty

Torque Auto LLC warrants parts and labor for a period of 12 months or 12,000 miles, whichever comes first, from the date of service, unless otherwise specified in writing. This warranty covers defects in workmanship and parts supplied by Torque Auto LLC.

This warranty does not cover:

• Damage caused by accidents, misuse, neglect, or unauthorized modifications
• Normal wear and tear
• Parts supplied by the customer
• Pre-existing conditions unrelated to the service performed
• Consequential or incidental damages

6. Cancellations and Rescheduling

We understand that schedules change. We ask that you provide at least 24 hours notice if you need to cancel or reschedule an appointment. Cancellations with less than 24 hours notice may be subject to a cancellation fee.

If we are unable to complete a service due to circumstances beyond our control (e.g., weather, vehicle inaccessibility, safety concerns), we will contact you to reschedule at no additional charge.

7. Customer Responsibilities

You agree to:

• Provide accurate information about your vehicle and the issues you are experiencing
• Ensure the vehicle is accessible and in a safe location for our technician to work
• Disclose any known safety hazards related to the vehicle
• Be present or have an authorized representative available at the time of service, or provide written authorization in advance
• Ensure the service location is legal and safe for our technician to work (e.g., not blocking traffic, not in a restricted area)

8. Limitation of Liability

To the fullest extent permitted by California law, Torque Auto LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of use, arising out of or related to our services or these Terms, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Torque Auto LLC is not responsible for pre-existing conditions, hidden damage, or issues unrelated to the service performed.

9. Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You may not:

• Use the website in any way that violates applicable local, state, or federal laws or regulations
• Attempt to gain unauthorized access to any portion of the website or its related systems
• Transmit any unsolicited or unauthorized advertising or promotional material
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Torque Auto LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or our services shall be resolved through binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You agree to resolve any disputes with Torque Auto LLC on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

12. California Bureau of Automotive Repair (BAR) Compliance

Torque Auto LLC operates in compliance with the California Automotive Repair Act (Business and Professions Code Section 9880 et seq.) and all applicable BAR regulations. As a licensed Automotive Repair Dealer (ARD), we are required to:

• Provide written estimates before beginning work
• Obtain written authorization before performing repairs
• Return replaced parts upon customer request (unless parts must be returned to the manufacturer or distributor)
• Provide an itemized invoice upon completion of work

13. Changes to Terms

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
